Terms of Service

By installing DualPerks from the Shopify App Store and using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not install or use the App.

You must be of legal age to enter into a binding contract and authorised to act on behalf of your Shopify store to accept these Terms.

DualPerks provides a loyalty and referral marketing platform for Shopify merchants, including:

• A loyalty points program for rewarding customer purchases
• Tier-based loyalty levels with configurable entry requirements
• A referral program enabling customers to invite friends
• An affiliate program with automated commission payouts
• Automated email notifications for loyalty events
• Analytics and customer management tools

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

DualPerks is offered under four plans: Free, Starter, Growth, and Pro. Plan details, including pricing and included features, are described on the Pricing page.

All paid plans are billed in Euros (EUR) through Shopify's billing system. By selecting a paid plan, you authorise Shopify to charge the applicable subscription fee to your payment method on file. Charges are non-refundable except where required by applicable law.

The Growth plan includes overage billing of €0.10 per loyalty order processed above 1,000 orders per calendar month. You will be notified if your store is approaching this threshold.

You may upgrade, downgrade, or cancel your plan at any time through the DualPerks app. Cancellation takes effect at the end of the current billing cycle.

You agree not to use DualPerks to:

• Violate any applicable laws or regulations
• Defraud customers or manipulate loyalty balances in bad faith
• Send unsolicited commercial email (spam) using the email notification system
• Reverse-engineer, decompile, or attempt to extract the source code of the App
• Use the App to build a competing product or service
• Interfere with the security or integrity of the App or its infrastructure

Violation of these terms may result in suspension or termination of your access to DualPerks without refund.

You are responsible for:

• Configuring the App correctly for your store, including loyalty point values, referral rewards, and email templates
• Ensuring that your use of DualPerks complies with applicable consumer protection and data privacy laws in your jurisdiction
• Communicating your loyalty program terms clearly to your customers
• Honouring loyalty points, referral rewards, and affiliate commissions that have been issued to your customers through the App

DualPerks and all associated software, designs, trademarks, and content are the exclusive property of DualPerks. These Terms do not grant you any rights to our intellectual property other than a limited, non-exclusive licence to use the App for its intended purpose.

You retain ownership of your store data and customer data. By using DualPerks, you grant us a limited licence to access and process this data solely as necessary to provide the service.

The App is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not guarantee any specific results from using the App, including any particular increase in sales, customer retention, or referral activity.

To the maximum extent permitted by applicable law, DualPerks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the App.

In no event shall our total liability to you exceed the amounts paid by you to DualPerks in the three months preceding the claim.

Either party may terminate these Terms at any time. You may terminate by uninstalling the App from your Shopify store. We may terminate your access immediately if you breach these Terms.

Upon termination, your access to the App will cease. We will retain your data for 30 days to allow for reinstallation, after which it will be permanently deleted in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of the European Union and the jurisdiction in which DualPerks operates. Any disputes shall be resolved in the competent courts of that jurisdiction.

We may update these Terms from time to time. We will notify you of material changes via email to the store owner's address on file at least 14 days before the changes take effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms.
